1. Engagement Framework & Scope of Work
These Terms of Service govern all technical consultations, digital engineering builds, cybersecurity testing, and maintenance retainers provided by CyberAkanksha. Specific project milestones, technical deliverables, fees, and acceptance criteria are formalized through individually executed Scope of Work (SOW) documents and Master Services Agreements (MSA).
2. Intellectual Property & Code Ownership
We believe in client sovereignty: upon complete settlement of agreed invoices for each project milestone, all custom application source code, database schemas, documentation, and digital assets produced specifically for the client transfer 100% to the client. CyberAkanksha retains only the right to reuse generic, open-source boilerplate utilities and libraries that carry no proprietary client business logic.
3. Ethical Security Testing & Rules of Engagement
All offensive security assessments, penetration testing, and vulnerability research conducted by CyberAkanksha require signed, written authorization and explicit Rules of Engagement (RoE). Testing is strictly confined to agreed IP ranges and domains. The client affirms they have legal authority over all target assets.
4. Disclaimer of Absolute Immunity
In ethical cybersecurity, no professional can guarantee that an audited system is 100% impenetrable. CyberAkanksha identifies and eliminates practical vulnerabilities in accordance with industry benchmarks (e.g., OWASP, CIS). We do not warrant that untested or future third-party software dependencies will remain free from zero-day exploits.
5. Limitation of Liability
To the fullest extent permitted by applicable law, neither party shall be liable for consequential, indirect, or punitive damages. CyberAkanksha's total cumulative liability arising from any engagement shall not exceed the total fees paid by the client under the specific applicable Scope of Work.
